How and why does Waterman Sport collect personal data?

Waterman Sport collects personal data in the course of its activities. In most cases, this concerns data requested from the data subject or data voluntarily provided by the data subject. Examples include an initial phone call between Waterman Sport and a (potential) customer or when a (potential) customer sends an email to Waterman Sport.

When processing personal data, Waterman Sport acts as carefully as possible. An essential part of this diligence is transparency. Waterman Sport considers it important that third parties and data subjects have insight into how it uses personal data and the reasons for doing so. For this reason, this statement has been drawn up. If you have any questions or comments after reading this Statement, you may contact Waterman Sport. Who exactly is Waterman Sport?

Waterman Sport is the controller for the processing of personal data. It is registered with the Chamber of Commerce under number 33036561, located at Radioweg 64, 1098 NJ Amsterdam, reachable by phone at 020 - 6949884 and by email at info@watermansport.nl.

Does Waterman Sport have a Data Protection Officer?

Waterman Sport has not appointed a Data Protection Officer. However, it has designated an employee as the primary contact person for privacy and personal data matters: Mr./Ms. C. Waterman. The full address can be found at the end of this statement.

Which personal data does Waterman Sport process and why?

Waterman Sport processes various types of personal data, for different reasons. The most common data processed are:

  • Identification data (name, email address, contact person, phone number, Chamber of Commerce number)
  • Location data (postal and/or business address)
  • Financial data (bank account number, payment details)

When applying for a job, Waterman Sport also processes additional data, such as:

  • Family composition, education, and qualifications

When you visit the Waterman Sport website, other data may also be processed, including:

  • Information about the device, location, software usage, etc.

The primary purpose of this processing is to establish an agreement with the customer. To achieve this, Waterman Sport and the customer must be able to communicate, for example, to identify the customer’s wishes and prepare a quotation.

The second main purpose is to perform the agreement concluded, for example, through periodic progress updates.

The third main purpose is to enable invoicing and payment (and collection, if necessary).

The fourth main purpose is to carry out marketing activities aimed at acquiring more customers or increasing brand awareness.

The final main purpose is to inform customers about developments that may be relevant to them.

Is Waterman Sport allowed to process this data?

Waterman Sport processes personal data if this is necessary to conclude or perform an agreement with a customer and/or supplier. This is the case, for example, when a quotation is requested, when an order is placed, or when Waterman Sport places an order itself. Furthermore, Waterman Sport processes personal data if its legitimate interests justify doing so. This will apply if it is reasonably impossible for Waterman Sport to carry out its activities without processing that data. Finally, in some cases, Waterman Sport may request explicit consent to use the data. The legal bases for processing are therefore:

  1. Processing is necessary for the performance of a contract to which the data subject is a party, or for taking steps at the request of the data subject prior to entering into a contract.
  2. Processing is necessary for the legitimate interests of Waterman Sport (or a third party).
  3. The data subject has given consent for the processing.

For category (2), all processing is necessary for Waterman Sport to provide its services. It cannot perform its work, communicate, or prepare quotations without using the customer’s personal data. Therefore, Waterman Sport has a legitimate interest in this processing. Waterman Sport believes this interest outweighs the interests of the data subject, based on two considerations: (1) from experience, such processing usually does not raise objections, and (2) data is not kept longer than necessary. To respect data subject rights, Waterman Sport only uses data strictly necessary to achieve the intended purpose.

For category (3), consent may be withdrawn at any time without giving reasons.

Are personal data shared with others?

Waterman Sport may in some cases share personal data with third parties it cooperates with. These are so-called “processors.” Waterman Sport has entered into agreements with these processors to ensure they handle the data with care, just as Waterman Sport itself does. For example, processors are contractually required to implement appropriate security measures, maintain confidentiality, and delete data when no longer needed.

Waterman Sport does not intend to share personal data with parties other than processors. At most, in rare cases, information may be shared with another employee of the customer or with parties directly related to the customer.

Will the personal data remain in Europe?

This refers to the European Economic Area (EEA), which consists of the EU countries plus Norway, Liechtenstein, and Iceland. Countries outside this area are considered “third countries.” In some cases, Waterman Sport may transfer personal data to third countries, particularly the United States. This only occurs if the EU has determined that the country ensures an adequate level of data protection. Regarding the US, transfers are only made to parties certified under the EU-US Privacy Shield.

How long will data be retained?

Waterman Sport retains the data it collects for varying periods, depending on the category of data and the method of collection. Exact retention periods are included in the register of processing activities maintained by Waterman Sport.

In determining these periods, Waterman Sport first considers statutory (minimum) retention obligations, such as bookkeeping requirements. It also aligns with retention periods from the Dutch Data Protection Act exemptions decree. For example, customer contact details are retained for a maximum of one year after the relationship ends. Finally, Waterman Sport considers its own and its customers’ interests, e.g. keeping documents with additional agreements for more than two years. If such documents (such as email correspondence) contain personal data, they will also be retained.

What rights do I have?

Under the law, you are a “data subject” and have specific legal rights. You may submit a request to Waterman Sport to access, receive, amend, or delete your personal data. You may also object to further processing. If Waterman Sport processes your personal data based on consent, you may withdraw that consent at any time.   2. To protect your personal data, Waterman Sport has implemented appropriate technical and organizational measures. A description of these measures is also included in the processing register. Waterman Sport periodically reviews whether these measures are still adequate.
  3. This privacy policy also applies to matters beyond customer relationships, such as applicant data retention periods.
